Israel: Supreme Court okays copying wanted ads

Israel Supreme Court rejected an appeal filed by Maariv, major Israeli newspaper, thus giving a green light for copying “Wanted” ads from one website to another. Maariv filed a lawsuit in 2005 against Alljobs.co.il and other defendants which operated a classified ads website. Maariv claimed the defendants used copyrighted material (wanted ads) from Maariv’s website and posted the ads on the defendants’ site without permission thus violating Maariv’s rights.

Maariv filed a motion for a temporary restraining order to prevent Alljobs from continuing to use the newspaper’s wanted ads on the defendants’ website. Tel Aviv District Court denied the motion ruling Maariv had no rights in contents of those ads and, given the choice, ad publishers would most certainly consent to publish the ads on as many websites as possible. Maariv appealed to the Supreme Court, claiming, among the rest, the District Court’s decision allowed any website to use classified ads from any newspaper, which may discourage the public from buying newspapers. Supreme Court ruled that Maariv’s concern was exaggerated and decided not to interfere with District Court’s opinion thus rejecting the appeal.
